Operative January 1, 2024, pursuant to Sec. 130 of Stats. 2022, Ch. 258.","effective":"2023-01-01","html":"<p>This article shall not apply to any of the following:</p><p>(a) A hazardous substance release site listed pursuant to Article 5 (commencing with Section <a href=\"/hsc/78760\">78760</a>) of Chapter 4 of Part 2 of Division 45, a site subject to an order or enforceable agreement issued pursuant to Article 1 (commencing with Section <a href=\"/hsc/78650\">78650</a>) of Chapter 4 of Part 2 of Division 45 or Section <a href=\"/hsc/78870\">78870</a> or <a href=\"/hsc/79055\">79055</a>, or a site where the department has initiated action pursuant to Article 10 (commencing with Section <a href=\"/hsc/79130\">79130</a>) of Chapter 5 of Part 2 of Division 45.</p><p>(b) A site subject to a corrective action order or agreement issued pursuant to Section <a href=\"/hsc/25187\">25187</a>.</p><p>(c) A site subject to a cleanup and abatement order issued pursuant to Section <a href=\"/wat/13304\">13304</a> of the Water Code.</p><p>(d) A facility that is subject to the requirements of Section <a href=\"/hsc/25200.10\">25200.10</a> or <a href=\"/hsc/25200.14\">25200.14</a>.</p>","text":"This article shall not apply to any of the following: (a) A hazardous substance release site listed pursuant to Article 5 (commencing with Section 78760) of Chapter 4 of Part 2 of Division 45, a site subject to an order or enforceable agreement issued pursuant to Article 1 (commencing with Section 78650) of Chapter 4 of Part 2 of Division 45 or Section 78870 or 79055, or a site where the department has initiated action pursuant to Article 10 (commencing with Section 79130) of Chapter 5 of Part 2 of Division 45.
